Foundation of Law: Absolutism vs. Relativism

Abstract

This article is organized with the following goals. First, ensuring that the reader has an understanding of two axiological theories, absolutism and relativism, and a general understanding of governing authorities such as democracies and autocracies. Secondly, this article will argue the article's statement that the foundation of US Law is based on the principles of relativism, while autocracy is based on the theory of absolutism. Understanding the concepts of these ethical theories will be enhanced with detailed explanations and examples. Then this article will delve into the relationship between ethics and law with a further section centered around ethics and government administrations and authorities. After this, the paper will give U.S. case law and constitutional examples to support the article's statement. Finally, the paper will conclude with a summary of the subject matter and any final thoughts on the matter.
